1. Definitions
- Agreement: the engagement letter and fee agreement signed between the client and Akar Jati, together with these Terms and Conditions.
- Office / We / Us: Akar Jati, a legal practice operating from 52 Jalan Meru, 41050 Klang, Selangor, Malaysia.
- Client / You: the individual or individuals who engage Akar Jati to provide legal services.
- Services: estate administration, title transfer, document inventory appointments and related legal work described in the fee agreement.
- Matter: the specific estate or legal task for which you have engaged the office.
- Disbursements: costs incurred on your behalf — court fees, land registry charges, stamp duty, notary fees — charged at actual cost.
2. Acceptance of Terms
These Terms and Conditions form part of the agreement between you and Akar Jati. By signing the engagement letter and fee agreement, or by proceeding with a service following a written quote, you confirm that you have read and accept these Terms. These Terms apply to all services provided by the office. You must be 18 years or older and have the legal capacity to enter into this agreement.
3. Services
The office provides three categories of service:
- Estate Administration for Families Abroad (RM 630)
- Title Transfer and Property Distribution (RM 410)
- Document Inventory Appointment (RM 150)
The scope of each service is set out in the fee agreement. Work outside this scope will be discussed with you and agreed in writing before being undertaken. Services are provided in Malaysia and are subject to Malaysian law.
4. Fees and Payment
Professional fees are as stated in the fee agreement and are denominated in Malaysian ringgit (MYR). Disbursements are charged separately at cost and listed in the final account.
- A deposit may be required at the commencement of estate administration matters.
- Invoices are due within fourteen days of issue unless otherwise agreed in writing.
- Overseas remittance charges are the client's responsibility and are estimated in writing at the time of engagement.
- Where matters are discontinued by the client before completion, fees are payable for work undertaken to that point.
- The office accepts bank transfer. Payment details are stated on each invoice.
5. Client Responsibilities
- Provide accurate, complete and truthful information about the estate and all parties involved.
- Inform the office promptly of any changes to circumstances that may affect the matter.
- Respond to requests for instructions and documents within a reasonable time.
- Execute documents — including powers of attorney required for overseas matters — in accordance with the office's instructions and within the timeframes advised.
- Pay invoices within the agreed period.
6. Timeframes
Timeframes provided by the office are estimates based on current processing times at Malaysian courts, land registries and financial institutions. They are not contractual commitments. Delays caused by third parties — courts, registries, banks, overseas authorities — are outside the office's control. The office will keep you informed in writing of any material delay and its cause.
7. Confidentiality
All information shared with the office in connection with your matter is held under solicitor-client confidentiality. It will not be disclosed to third parties except where required to carry out the services (e.g. corresponding with a bank on the estate's behalf), where you have given written consent, or where disclosure is required by law or a regulatory authority.
8. Intellectual Property
Documents, letters, legal instruments and other work product prepared by the office are produced for use in your specific matter. They may not be reproduced for other purposes or shared with third parties without the office's written consent. The content of this website is the property of Akar Jati and may not be copied or reproduced without permission.
9. Document Inventory Appointment — Specific Terms
The Document Inventory Appointment is a standalone service. At the conclusion of the appointment, no further engagement is suggested or expected. The inventory and notes produced are for the client's use only. The appointment does not constitute legal advice on the administration of the estate; it is a working session to organise existing documents and identify gaps.
10. Disclaimers
Services are provided on the basis of the information available at the time of engagement. The office cannot warrant a particular outcome in any legal matter, as outcomes depend on the decisions of courts, registries and financial institutions outside our control. Legal advice given is based on Malaysian law as it stands at the date of the advice. The website content is provided for general information only and does not constitute legal advice.
11. Limitation of Liability
The office's liability for any loss arising from a professional error or omission is limited to the professional fees paid for the matter in which the error occurred, or the amount covered by the office's professional indemnity insurance, whichever is greater. The office is not liable for delays or losses caused by third parties including courts, registries, financial institutions or overseas authorities.
12. Termination
Either party may terminate the engagement by giving written notice. The office may terminate the engagement where payment is overdue, where instructions cannot be obtained within a reasonable time, or where instructions are inconsistent with professional obligations. On termination, the client is responsible for fees and disbursements incurred to that date. The office will hand over the client's own documents promptly on settlement of any outstanding amounts.
13. Disputes and Governing Law
These Terms are governed by the laws of Malaysia. Any dispute will first be referred to discussion between the parties. If unresolved, it may be referred to the Bar Council's Complaints Committee or to the courts of Malaysia. The parties agree to submit to the non-exclusive jurisdiction of the courts of Selangor, Malaysia.
14. General
- These Terms constitute the entire agreement between the parties in relation to their subject matter.
- If any provision is found to be unenforceable, the remaining provisions continue in full force.
- A failure to enforce a right does not constitute a waiver of that right.
- These Terms may be updated. The current version will be posted on this website with its effective date.
